it's halloween, guys! exciting! got a big day ahead. a lot of trick or treaters headed out there but not just yet i don't think. but if you are headed out the door right now, we have chilly temperatures, 40s and 50s right now. i think by the afternoon, doesn't look very spooky at all. we'll have your halloween forecast coming up. >> and out the door right now, it looks like we have a couple accidents including one in novato southbound 101 at atherton avenue an overturn crash. it is blocking one lane. so we'll have all the details in your halloween morning commute coming up. >> you are the only one rocking the orange today. >> i'm a caltrans construction cone! [ laughter ] >> attagirl! good stuff! we begin with news this morning, a number of people in antioch recovering from dog bites after two dogs charged them a little before 9:00 last night. a man was walking his two dogs when two other dogs apparently attacked them. three neighbors came out of their homes to see what was going on. they too were bitten. police shot and kill one of the attacking dogs. the other ran away but was captured later and is now

quarantined this morning in antioch. a north bay teenager who thought he could get away with anything is looking at up to 30 years in prison. kpix 5 reporter brian webb says, mallet wade's crimes were done -- matt wade's crimes were done to get a girl. >> reporter: while max wade faces his fate as a convicted criminal his mother can no longer contain herself, crying out in court, i love you, baby! >> i love you, baby! >> reporter: wade was already larger than life as a teenager known for things like breaking into a marin county mansion to host his own party. his followers tried to bust him out of jail and wrote a rap song in his honor. [ rap ] >> reporter: but the juries convicted him of firing several shots into a moving car from his motorcycle jealously aiming at a boy riding with the girl max loved. >> i think it's a very, very difficult time for the family.

>> reporter: max was also convicted of stealing a $200,000 lamborghini belonging to celebrity chef guy fieri, doing it by rapelling into a san francisco dealership and driving the car off the showroom floor another effort to impress the girl. >> my car is a very small quite frankly n consequential. there's -- inconsequential. there's a big issue on the table. >> reporter: police found the car, guns and radio jamming equipment in a richmond warehouse along with a san francisco police uniform and badge, which young max will be trading in for a jailhouse jumpsuit. brian webb, kpix 5. >> max wade was a juvenile when the crimes were committed but was tried as an adult. he will be sentenced in december. well, one man you would least expect to be the victim of a crime recently had his car broken into. someone broke into san francisco police chief greg suhr's house outside his home and stole a jacket. the chief says he is not immune

to crime and the case remains unsolved. a man is telling his story about an encounter with a sonoma county sheriff's deputy who fatally shot a teen near santa rosa. the teen andy lopez was armed with a pellet gun. kpix 5's andria borba spoke with a man who says the same deputy pulled a gun on him two months ago. >> reporter: it was august 21 around 8:30 a.m. when 57-year-old jeffrey westbrook of santa rosa was carpooling to work on highway 101 when he was pulled over by sonoma county sheriff's deputy erick gelhaus. >> reporter: i felt something not right with him. >> reporter: jeff pulled over in this black bmw and on a narrow shoulder and steep hillside. jeff says he offered to make more room for gelhaus to stand when a simple traffic stop for failing to use a blinker went sideways. >> s the car started to move he screams turn the car off. i'm still looking at him he

pulled his weapon out and now point-blank. >> reporter: jeff says the gun's barrel was a foot from his head. >> i never had a gunpoint at me. >> reporter: he says that's when gelhaus told him to get out of the car and it happened again. >> when he asked me to, you know, if i had weapons he actually went to the gun the second time. >> reporter: jeff later learned a car matching his was part of a be on the lookout call in a series of emails exchanged with the deputy sergeant about filing a formal complaint the sheriff's department defense gelhaus and then tuesday jeff connected the dots of the officer who pulled a gun on him to andy lopez. he was stunned. >> i don't know where i'm at. i just know that i'm feeling that something could have been done. >> reporter: one of the final emails in the chain says deputy gelhaus will be unavailable to meet for the next several weeks due to unforeseen circumstances. the email dated october 23rd was sent a day after andy was shot. >> i feel forth family. >> reporter: andria borba, kpix

5. >> a lawyer for deputy gelhaus spoke with the "san francisco chronicle." the attorney says gelhaus and a deputy he was training thought andy lopez's gun was a real ak- 47. she said gelhaus opened fire because they believed lopez, quote, posed a real imminent and lethal threat. investigators say a witness heard gelhaus yell at the teen twice to drop the weapon. well, i would imagine some new england baseball fans are still celebrating right now as the red sox are world series champions once again. it's the third series victory for boston in 10 seasons but it's the first time since 1918 the team actually got to clinch the title at fenway park. fans filled the streets after that final out. >> it hasn't happened at fenway park for 95 years, the red sox are world champions. >> that was about 9:00 last night. the sox beat the cardinals 6-1

it was a 10-hour pit stop no one expected. a delta flight was supposed to come to san francisco from tokyo nonstop. but a warning light about possible engine problems forced it to land in a remote area of alaska. kpix 5's joe vazquez with how the passengers passed the time in the tiny town. >> reporter: there's not much in cold bay in the aleutian islands of alaska but more than 170 people had to get off their delta plane because of engine problems and find somewhere to wait for another plane to come. some waited at a nearby school, others waited at the only bar in town. that other plane finally came and after about a six-hour flight and a total of 20 hours into their journey, they arrived at sfo around 9:00 exhausted. >> ever been to alaska before? >> no. never even before on my bucket list. so now i can add it to my bucket list and cross it off. neilson from lodi. and 1-year-old ellie, their newly adopted daughter from china. >> hi -- >> just kind of what's going on here? and then all of a sudden, we could see that they were turning north towards alaska. i'm okay, something's wrong. but we were safe. >> reporter: joe vazquez, kpix 5. >> the original plane will stay at cold bay until mechanics can check it out. hayward police have a suspect for the murder of a man who was shot to death in front of his daughter nearly four years ago. 24-year-old dereak turner of vallejo was arrested on tuesday. investigators believe turner got into a verbal fight with thomas cunningham over cunningham's dog and then fired. cunningham was killed in front of his 13-year-old daughter after he just bought her ice cream. the search is on for a man who lives at a now closed assisted care facility in castro valley. 65-year-old edmond bascom wandered away from valley springs manor on friday.

that was a day before paramedics rescued the remaining residents after discovering the home was basically closed and operating with a skeleton staff. edmond was last seen at the san leandro bart station. a man caused a crash in san francisco's inner richmond district. the driver of the stolen car ran a red light at 10th and geary and hit a lexus suv. the impact flipped the lexus over sending it crashing into two other cars. all four drivers went to the hospital along with a passerby hit by flying debris. 4:40. the national security agency broke into communications centers for silicon valley giants yahoo and google according to a new report in the "washington post" which says the nsa retrieved millions of communication records from those companies. and an italian magazine says the nsa recorded vatican phone calls when cardinals were gathering to elect the new pope earlier this year. general keith alexander director of the nsa says the

spots. some 50s and 40s under mostly clear skies this morning. this afternoon, enjoying some sunshine and get this, temperatures in some of the valleys near seasonal and very comfortable, mid-70s there. a lot of 60s and sunny inside the bay. low 60s and cool at the coast. high pressure going to stick around for a couple of days so more sunshine today and maybe even a little bit tomorrow then cooling down as low pressure works towards the bay area this weekend. traveling around the bay today you will find sunshine in the south bay 72 degrees in morgan hill. 70 in sunnyvale. 71 in redwood city. east bay temperatures running up into the 70s in many spots as high as 74 in brentwood, 74 livermore, 72 pleasant hill. inside the bay a lot of 60s and plenty of sunshine throughout the day. looks like the next couple of days we'll warm those temperatures up then cooling down just slightly with a few more clouds over the weekend. but staying dry into the first part of next week. all right. let's check the roads now with

your "kcbs traffic" with elizabeth. >> thank you, lawrence. outside we go start you off with a live look at the south bay because that's where we sent our photographer this morning, 101 near trimble exit and everything looks really good both directions northbound and southbound. getting a check of the bay bridge now, there may be some lower deck roadwork leaving san francisco but at the pay gates, everything is very quiet. same thing on all your approaches including the eastshore freeway, only 18 or 19 minutes from the carquinez bridge to the maze. san mateo bridge traffic no delay at all right now leaving hayward. the marin county commute a few bumps in the road including southbound 101 atherton avenue. overturn accident no serious injuries with that accident so they are working to clear it. also another one northbound 101 freitas parkway san rafael counter-commute and we're not seeing any huge delays because traffic is light in both directions at this time of the morning. bart on time. they should have more than 20 trains all good to go. and if you are about to hit the road, make sure you tune to our radio partners, kcbs, 740-am or

106.9 fm. that's the latest from here. back to you guys. >> thank you. futures trading is down this morning ahead of the opening bell. cbsmoneywatch's wendy gillette reports stocks lost ground yesterday on speculation about the fed. >> reporter: the federal reserve is keeping low interest rates in place for now after a policy meeting yesterday, the fed did indicate that the u.s. economy seems to be improving. but it will continue to buy $85 billion worth of bonds each month to encourage borrowing and spending. analysts expect the fed to taper the stimulus program sooner than expected, sometimes next year. dow and nasdaq down yesterday. overseas, asian markets also lost ground in today's trading. facebook grew by 60% thanks to growth in its mobile advertising business.
